Some cookies are set by our marketing partners, including Rakuten Advertising. Rakuten Advertising supports our affiliate marketing campaigns, where a third party earns a commission if a customer purchases something from us after clicking an ad for our product on the third party’s site. We also use advertising pixels and similar tracking technologies provided by third-party platforms, including the Meta Pixel (provided by Meta Platforms, Inc.) and the TikTok Pixel (provided by TikTok Inc.), as well as pixels from other advertising partners. These pixels are embedded directly into our Platform, and when you visit the Platform, they automatically collect and transmit certain information — such as your IP address, browser type, pages visited, and actions taken on the Platform (e.g., product views or purchases) — to the respective platform. This transmission is a function of how these technologies operate and cannot be selectively suppressed by us on a per-user basis. The information collected by these pixels may be used by those platforms to measure the effectiveness of our advertising campaigns, build audience segments, and deliver targeted advertising to you on their platforms and elsewhere. California Business & Professions Code Section 22575(b) entitles California residents to know how we respond to “Do Not Track” browser settings or signals. We do not currently take actions to respond to “Do Not Track” signals, as a uniform technological standard has not yet been developed. We may adopt a standard once one is created.

While we have not “sold” personal information as that term is commonly used, in the last 12 months, we have transferred certain categories of personal information to third parties: Identifiers, Internet or other electronic network activity, and geolocation data to data analytics providers. We do not knowingly sell or share for cross-context behavioral advertising the personal information of consumers under the age of 18.
The California Consumer Privacy Act of 2018, as amended by The California Privacy Rights and Enforcement Act of 2020 (collectively, the “CCPA”), prohibits third parties who purchase personal information from us from reselling it unless you receive explicit notice and an opportunity to opt out of further sales or sharing. However, any third party with whom we are allowed to share your personal information is authorized to use it in accordance with our contractual obligations and their own privacy policies (over which we have no control). You agree that we are not responsible or liable for their actions or omissions.
If you provide personal information about another person to us, you represent that you have that individual’s consent to allow us to collect, use, or disclose their information as described in this Policy, and we will rely on this representation.
Update Your Information
You can modify your account by emailing us at service@shapejelly.com. Even after you cancel your account or request deletion of your personal information, copies of some information may still be viewable if, for example, you shared it with other services (e.g., social media). Your account may not be instantly inaccessible to others due to caching technology. Additionally, we may retain information related to your account after cancellation or deletion to comply with legal requirements, for internal security or recordkeeping, or for fraud detection. We may not be able to completely delete all your personal information due to financial, contractual, or legal requirements, or technical constraints.

This section applies only to California residents covered and protected by the CCPA. If you are not a California resident, the rights and obligations described here may not apply to you.

California Civil Code Section §1798.83 permits California residents using the Platform to request certain information about our disclosure of personal information to third parties for their direct marketing purposes (if applicable). Right to Request Deletion
You have the right to request that we delete any personal information about you that we have collected. Upon receiving a verifiable consumer request to delete your personal information, we will delete it and direct our service providers and contractors to delete it from their records, subject to certain CCPA exceptions, including if it is necessary for us or our service providers to maintain the personal information to:

You have the right to request that we correct any inaccurate personal information, taking into account the nature of the information and the purposes of processing. If we receive a verifiable request to correct inaccurate personal information, we will use commercially reasonable efforts to do so.
Non-Discrimination
If you are a California resident covered by the CCPA, we will not discriminate against you for exercising any of your rights under the CCPA (including if you are an employee, applicant, or independent contractor). Except as permitted by the CCPA, we will not:

Participation in the Shapejelly Club, Shaperjelly Club+, and Shapejelly Credit loyalty programs may involve collecting your purchase history, Shapejelly Credit usage, and other commercial information to create internal profiles. This profiling is used to analyze your purchase history, optimize promotional offers, and manage our business. The categories of personal information collected are outlined in the data collection table, and participation is entirely voluntary.
Opt-Out Right

Any service providers or contractors assisting us with the above services may not use your sensitive personal information (to the extent they have actual knowledge it is sensitive) for any purpose outside our instructions. They are required to limit their use to our written contract terms and our instructions.

A verifiable consumer request can only be made by you or a person/entity registered with the California Secretary of State and authorized by you to act on your behalf. To ensure a prompt response, your request should include sufficient information to verify your identity (e.g., full name, email address, mailing address) and a detailed description of your request. We will review the identifying information against our records to verify the request. We cannot respond or provide personal information if we cannot verify your identity or authority, or confirm the information relates to you.
If using an authorized agent, you must provide proof of signed, written authorization, along with your full name, email address, and mailing address for identity verification. We will confirm receipt of your verifiable request within 10 business days, and provide information about our verification process and expected response time.
We will disclose and deliver the requested personal information within 45 days of receiving your verifiable request. If we need more time (up to an additional 45 days), we will notify you of the extension and reasons for the delay. The disclosure will cover the 12-month period preceding receipt of your request.
If your requests are manifestly unfounded or excessive, we may charge a reasonable fee or refuse to act on the request. If we refuse, we will notify you of the reasons.
Children’s Privacy
Our services are not directed to, and we do not knowingly collect personal information from, children under the age of 18. If we discover we have received personal information from a child under 18, we will promptly delete it. Please contact us immediately if you become aware that a child under 18 has provided us with personal information, so we may investigate and delete the information as appropriate.
